Do You Need a Bankruptcy Lawyer?

    Last updated 2 years ago

Bankruptcy can be a stressful experience for you and your family. In order to get through the experience of filing bankruptcy as quickly and successfully as possible, it is best to hire a bankruptcy lawyer. Below are some of the main benefits of working with a bankruptcy lawyer to improve your financial future:

    Bankruptcy Law is Complicated

All law is complicated, of course, but bankruptcy law is purposely complicated.  Several years ago, it was decided that the bankruptcy laws were too lenient and that many people who did not genuinely need to file for bankruptcy were doing so to take advantage of getting out of their debt.  Whether this was true or not, the end result is that now the laws are written in such a way to make it difficult to file for Chapter 7 bankruptcy, the most lenient of all forms of bankruptcy.  In order to successfully file for Chapter 7 bankruptcy, you’re going to need a lawyer to help you navigate the various forms and conditions.

    Negotiating with Creditors is Difficult

If you have a steady job, then you probably won’t qualify for Chapter 7 bankruptcy—and that makes getting a lawyer even more important.  The kind of bankruptcy you’d most likely be eligible for is Chapter 13 bankruptcy, which requires you to present a repayment plan to the court and then spend the next several years making payments according to that plan.  A lawyer can come up with a plan that’s not so financially onerous to you, help you protect your assets from creditors, and help you create a suitable repayment schedule.

Without a bankruptcy lawyer present, you would probably become overwhelmed and would not be able to defend yourself from your creditors.  A bankruptcy lawyer will help to protect you.

If you’re in need of a bankruptcy lawyer, then you should consult with American Law Center.  American Law Center is a great San Bernardino law practice that has bankruptcy, criminal law, and divorce lawyers.  For more information about how we can help you through your bankruptcy, call (909) 498-4566 today.

What is Covered Under Family Law?

    Last updated 2 years ago

We’ve all been there. We’ve all come across an unfortunate issue that requires some sort of legal action. From speeding tickets to filling for divorce, whatever the issue may be sometimes it’s best to find legal representation to hopefully resolve the issue. If you’re dealing with family issues and find yourself needing a lawyer, it might be helpful to understand what is classified under family law.

    Issues Related to Children:
Most issues related to children are governed by family law.  Family law concerns the technicalities of adoption and guardianship; it also concerns when parental rights can be terminated or a parent can be held responsible for a child’s actions.  Foster care and child abuse are both adjudicated under family law, as is the question of emancipating a minor.  Even questions of paternity are settled by family law.  If you have children, then chances are that any legal issues you might have will be solved under family law.

    Issues Related to Marriage:
If you live with a spouse, but are not married, then you do still have legal rights and those rights are protected under family law.  Marriage also falls under family law.

    Issues Related to Divorce:
Divorces are decided by family law, as is child custody.  Child support also falls under family law—and all too often, that includes child support enforcement.  If you do not pay your child support, then you will be dealt with under family law.

    Issues Related to Domestic Violence:
If you are a victim of domestic violence, then at least some of the crimes committed against you will be dealt with under family law.  Violence will typically be dealt with in criminal court, but family law is what allows for the restraining orders that are designed to keep your abuser from contacting you or harming you again.
