    • You don’t represent a business. According to the U.S. Bankruptcy Code, only natural persons (individuals) are eligible to file for Chapter 13 bankruptcy. If you represent a corporation or some other business entity, you may consider filing bankruptcy under Chapters 7 or 11 of the Bankruptcy Code.
    • You have a steady income. Because Chapter 13 bankruptcy results in the reorganization of your debt, it is important that you have a regular income. Otherwise, you will have trouble sticking to the reorganization plan that you and your bankruptcy lawyer prepare.

    • Your debts are within the Chapter 13 range. Debt limits do exist for those who wish to file Chapter 13 bankruptcy. These limits are adjusted regularly for increases in the cost of living. As of April 2010, they were $1,081,400 of secured debt and $360,475 of unsecured debt. If your debt exceeds either of these limits, you may wish to consider Chapter 7 bankruptcy.
    • Reorganization of your debt appeals to you. Under Chapter 13 bankruptcy, you will still be held responsible for some or all of your debt. The repayment of this debt, however, will be made much more manageable. After three to five years of sticking to the payment plan you and the courts agree upon, remaining debts may be discharged.

    Chapter 13 bankruptcy can provide consumers who are in serious financial trouble with a great opportunity. Bankruptcy laws pertaining to Chapter 13, however, are notoriously complex.
